3. User Responsibilities

As a user of ReferralHarvest, you agree to:

• Obtain proper consent from all customers and referrals before adding their contact information to the platform
• Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier regulations
• Not upload purchased, scraped, or non-consented phone numbers to the platform
• Maintain accurate and up-to-date contact information
• Use the platform only for lawful business purposes

4. Messaging & SMS Compliance

ReferralHarvest sends SMS messages only as directed by users through the platform. All messaging activities must comply with the following requirements:

• All messages must be consent-based, with recipients having explicitly agreed to receive communications
• End recipients may opt out at any time by replying STOP to any message
• Users must honor all opt-out requests immediately
• Message content must be truthful and not misleading

ReferralHarvest is not responsible for any misuse of messaging features by users. Users assume full responsibility for ensuring their messaging practices comply with all applicable regulations.

5. Intellectual Property

All software, branding, content, trademarks, and intellectual property associated with ReferralHarvest are owned exclusively by ReferralHarvest and its licensors. Users may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may they reverse engineer or attempt to extract the source code of that software.

6. Limitation of Liability

To the fullest extent permitted by law, ReferralHarvest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the platform. Our total liability for any claims arising from these terms shall not exceed the amount you paid to ReferralHarvest in the twelve months preceding the claim.

7. Termination of Service

ReferralHarvest reserves the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms and Conditions, messaging compliance failures, or any conduct that we determine to be harmful to our platform, users, or third parties. Upon termination, your right to use the platform will immediately cease.
